1. The Plaintiff:
A. Defendant B Co., Ltd.: (a) KRW 281,009,443 and its therefrom from December 10, 2013 to January 16, 2015.
Reasons
1. Basic facts
A. 1) The Plaintiff as a party author and as Defendant B Co., Ltd. (hereinafter “Defendant B”).
(2) Defendant B is a company that produces the drama “E” (hereinafter “the instant drama”) jointly with Defendant C Co., Ltd. (hereinafter “Defendant C”).
3) Defendant C is Defendant D Co., Ltd. (hereinafter “Defendant D”).
(4) Defendant D is a company that has produced the instant drama jointly with Defendant B upon being entrusted with the production of the instant drama. Defendant D is a company that organized and broadcasted the instant drama.
B. On March 24, 2010, the Plaintiff and Defendant B entered into a written contract between the Plaintiff and the Defendant B with the content that the Plaintiff would write a dramatic copy of the broadcast pictures produced by Defendant B exclusively to Defendant B (Evidence A 3; hereinafter “instant written contract”).
The parts relating to the instant case in the terms of the above contract are as follows:
(B) In the following, the term “A” refers to Defendant B and “B” refers to the Plaintiff, and “B” refers to the Plaintiff, and the term “B” refers to an agreement between Defendant B and the Plaintiff to act as an exclusive author of the broadcast image production product produced by “A” during the term of this contract as the exclusive author of the broadcast image production product produced by “A” during the term of this contract, and it does not perform for any third party other than “A” in addition to “B”.
The basic Plaintiff fee for 50 times in total on the basis of the continuous broadcasting hours and 60 minutes per time of the program commissioned for writing the program contents: The basic theater and the data research cost (However, the remainder of 165,33,373 won may be changed following the revision of the regulations with the broadcasting company): 234,66,627 won: 40 million won (eight million won per time x 50 times).
