Defendant shall be punished by imprisonment for a term of one year and six months.
Reasons
Punishment of the crime
On October 7, 2015, the Defendant was sentenced to a suspended sentence of ten months for the crime of unlawful use of automobiles by the Daejeon District Court, etc. on October 7, 2015, and on April 20, 2016, the same court was sentenced to one month of imprisonment with prison labor for night intrusion and larceny, etc., and on July 8, 2016, the said judgment became final and conclusive on July 8, 2016, and the execution of each of the said punishment was completed at the port prison on August 11, 2017.
1. On June 2018, the Defendant embezzled the deserted Articles in possession: (a) obtained a copy of the driver’s license of a motor vehicle lost by the victim C before a restaurant located in Seo-gu, Seo-gu, Daejeon; (b) but did not take necessary procedures, such as returning it to the victim.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
2. On July 20, 2018, at E points in Seo-gu, Daejeon on July 20, 2018, the Defendant: (a) had a driver’s license under C in his/her name, such as the statement in paragraph (1); (b) had the driver’s license under C in his/her name; (c) stated the “C”, “F” in the resident number column, and “C” in the lessee’s name column, respectively; and (d) as if the contract for the vehicle lease was duly completed, the Defendant presented to G employees of the said siren company that had the above car lease contract; and (c) had the driver’s license under the name of the Commissioner General of the Daejeon Regional Police Agency under the name of the Daejeon Local Police Agency, a public document that was held by the said G upon receipt of a request for a driver’s license.
Accordingly, for the purpose of uttering, the Defendant forged one copy of the car lease contract in the name of C, which is a private document related to rights and obligations, and exercised it, and denied official documents under the name of the Daejeon Regional Police Agency.
3. Violation of the Act on Special Cases concerning the Settlement of Traffic Accidents (Bodily Injury) on July 24, 2018.
