1. The Defendant shall pay to the Plaintiff KRW 31,231,00 and interest rate of KRW 15% per annum from April 28, 2016 to the date of complete payment.
Reasons
1. On May 18, 2015, the Plaintiff entered into a sales contract with the Defendant for selling a price of KRW 320,000,000 (hereinafter referred to as “instant sales contract”) with the content that the Plaintiff sells a road portion of KRW 37,00,000 to the Defendant (hereinafter referred to as “instant land”) for entering the said land, in addition to the said land, by dividing the land located in Gyeonggi-do Cri (hereinafter referred to as “Cri-gun D-gun”). At the time of entering into the said sales contract, the Plaintiff agreed to additionally transfer the area of a road portion of KRW 37,00,00 to the Defendant, in addition to the said land, to the Defendant.
The Plaintiff, under the name of Suwon District Court 2015Gale 9419 (hereinafter “the Jeonwon District Court”), charged Nonparty G with each point of 2,3,4,5,9,10,11, and 2 attached drawings out of the part inside the ship (a) of 21 square meters and 822 square meters in sequence connected each point of 5,6,7,7,8,9,000 square meters in the attached drawings among the part (c) of 16 square meters in the ship (a) and 118 square meters in the attached drawings among the part (a) of 1,2,11,12, and 18 square meters in sequence connected Nonparty G with the point of 803 square meters in H., the Plaintiff filed a lawsuit seeking partial adjustment of the above part of the land (hereinafter “instant land”) [1,00 square meters in the attached drawings], and the Plaintiff filed a claim for the transfer registration during the period of 1,000 square meters in lots [1,000 square meters in the aforementioned part of the land].
