1. The defendant's KRW 50,672,00 for the plaintiff and 5% per annum from January 24, 2020 to April 29, 2020 for the plaintiff.
Reasons
1. Facts of recognition;
A. On December 29, 2014, the Plaintiff (the Plaintiff’s birth B’s agent) entered into a contract with the Defendant (the Defendant’s father D’s agent) on the lease of land and ground buildings E, facilities for gas stations, authorization and permission rights, etc. (hereinafter “the lease of this case”) from the Defendant (the Defendant’s father D’s agent”) as follows:
Article 1 (Lease Objects) A lessor shall lease the leased objects listed in the attached Form 1 to a lessee.
Article 2 (Term of Contract) The term of validity of this Agreement shall be from December 29, 2014 to December 28, 2016.
except that if there is no written notice by either party of the termination or modification of the contract one month prior to the expiration of the contract, this contract shall be automatically extended every one year under the same conditions.
Article 3(1)(1) The lessee shall pay the lessor a rent of KRW 2,00,00 per month (excluding value-added tax); 2) The lessee shall pay the lessor a rental deposit of KRW 60,00,000 to the lessee pursuant to this contract; 3) the lessee shall not refuse the payment of the rent on the ground that the lessee has a rental deposit in cash on the 20th day from the following month of the month in which the date of this contract is included but the lease deposit remains: Provided, That if the payment date falls on a legal holiday, the following day shall be the following day; and if the actual date of use shall be within 30 days, the lessor shall be paid on the daily basis; hereinafter the same shall apply) Article 6(1) of the Act provides that the lessor shall gratuitously transfer the right to authorize the operation of the gas station and auxiliary facilities held by the Defendant as of the date of this contract to the lessee.
2) When this contract is terminated, the lessee must, without any condition, transfer to the lessor the right of authorization and permission related to the operation of the gas stations and ancillary facilities mentioned in the separate sheet (1) that it acquired pursuant to paragraph (1) above.
For this purpose, the lessor shall complete all the documents necessary for the transfer and acquisition of the authorization and permission prior to the end of this contract.
