A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On December 22, 2017, the Defendant reported an advertisement for the sale of phiphones from the Internet portal site “D” on December 22, 2017, and decided to purchase approximately one gram of 400,000 won in phiphones by linking the phiphone seller F through “D”, a smartphone hosting-type type E, to purchase approximately 1 gram of phiphones, and around 20:36 December 22, 2017, the Defendant received approximately 1 gram from the said F’s accomplice in the subway station located in Seo-gu, Daegu-gu, Seoul Special Metropolitan City, about 400,000 won in cash from the said F’s accomplice.
2. On December 22, 2017, the Defendant administered a phiphone in a way that he/she takes two spons rapidly on a water disease at the Defendant’s residence located in J 201 of Busan Metropolitan City around December 22, 2017, by sticking two spons as soon as possible at one spons (0.03g) from among the spons purchased, such as paragraph 1, and by attaching a spons as soon as possible, the Defendant sponsed a phiphone in a way that he/she inhales as soon as possible one end of the spons.
3. On July 3, 2018, the Defendant: (a) on the Internet portal site “D”; (b) reported the advertisement for the sale of phiphones at “D”; and (c) decided to purchase phiphones by printing them with a seller of phiphones (E clinic K) through a smartphone-rating type E; and (d) on July 3, 2018, at the Saemaul Treasury located in the Gyeyang-dong, Gyeyang-dong, Busan Metropolitan City, under the order of a person who was not entitled to the above name, transferred KRW 4.50,000 of the purchase price of phiphones from L to the Saemaul Treasury in the name of M (Account No. N.); and (c) on July 30, 2018, at the P Center located in the Dong-gu, Daegu-gu, Seoul Metropolitan City, the Defendant sent at least 50,000 phiphones to Qphones, an accomplice of the said seller.
4. On July 3, 2018, the Defendant, on or around July 3, 2018, scopon medication: (a) thrown two fasts in a water disease in the above Defendant’s residence at his/her own residence, sticking up one set of copphones purchased, such as paragraph (3), with a single set of 0.03 grams; and (b) thrown the copter.
