1.『2013고정813』 피고인은 2012. 8. 19. 06:20경 고양시 일산동구 B빌딩 1층 복도에서, 112 신고를 받고 출동한 일산경찰서 C지구대 소속 경사 D가 술에 취해 복도에 쓰러져 잠을 자고 있는 피고인을 귀가시키기 위해 흔들어 깨우자, “개새끼, 짭새 새끼들, 시발 새끼들”이라며 욕설을 하고 경찰관의 얼굴에 침을 뱉고, 주먹과 발로 경찰관을 때리려 하고, 계속하여 순찰차에 승차하여 지구대로 연행되는 과정에서 경찰관에게 같은 욕설을 하고, C지구대 내에서도 같은 욕설과 바닥에 침을 뱉는 등 위력으로 경찰관의 주취자 안전에 관한 정당한 공무집행을 방해하였다.
