A defendant shall be punished by imprisonment for four months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On January 4, 2014, at around 22:52, the Defendant: (a) laid a taxi in the vicinity of Gwangju-si and around 23:47 on the same day; (b) but, at around 23:47 on the same day, the Defendant refused to pay the taxi expenses more than the anticipated taxi expenses; (c) the Defendant, upon receiving a 112 report that the Defendant did not provide guidance on the taxi at a taxi without paying a charge, recommended the Defendant to pay a taxi fee from the police officer D and slope belonging to the Seocheon-gu Police Station C District of the Seocheon-si Police Station C District, which was dispatched, and continued to refuse to pay a taxi fee from the said police officer, and was accompanied to the F District as well as the said police officer in Seocheon-gu F District.
1. 경찰관 D, 경찰관 G에 대한 공무집행방해 피고인은 같은 날 23:50경 위 C지구대 안에서 위 D로부터 ‘한번 더 기회를 줄테니 택시요금을 지급하라’는 권유를 듣고 오히려 화가 나 D에게 “야, 이 씨발 새끼야, 꺼져”라는 등 수 회 욕설을 하면서 손과 발로 D의 몸과 다리를 수 회 때리고 찼다.
이어 피고인은 위 일시, 장소에서 C지구대 소속 경찰관인 순경 G이 피고인의 폭행을 제지하기 위하여 접근하자 갑자기 G에게 “좆까라 씨발 새끼야”라고 욕설을 하면서 발로 G의 낭심 부위를 1회 찼다.
Accordingly, the defendant assaulted police officers, thereby obstructing police officers' legitimate execution of duties concerning criminal investigation and situation service.
2. The Defendant: (a) was arrested of a police officer from a slope E, who was a police officer, at the above time, at the above location; and (b) was on board the police officer, at the back seat of the 112 patrol police officer, with E at the 112 patrol seat; and (c) had the police officer go to the House Police Station for the investigation of the Defendant.
