Defendants shall be punished by imprisonment for two years.

However, with respect to Defendant B, it shall be for 4 years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendants are married with a couple, and the Defendant A is the owner of a multi-household house at the time of macro-government.

From December 2016, the Defendants got pressure to repay the total amount of KRW 100 million to tenants of the above “C” multi-household houses due to their failure to refund KRW 100 million. On April 2017, the Defendants: (a) filed an application for real estate mortgage loan with the victim D’s association; (b) notified the Defendants of the security deposit that the Defendants should return to the victims; and (c) had been aware of the security deposit that the Defendants should return to the victims; and (d) had the mind

1. On April 8, 2017, the Defendants agreed to enter into a false real estate lease agreement in which deposit for lease is less than the actual amount, together with the Defendants who forged private documents.

Accordingly, on April 9, 2017, Defendant B drafted 12 copies of the real estate lease agreement in the name of 12 lessees in total, as described in the list of crimes, on the same day, stating “The location: F of the building C, the deposit for lease on a deposit basis: KRW 10,000,000,000,000, and the lessor A, and the lessee” in the name of G, as seen in the real estate lease agreement form, at the Defendants’ residence in the above “C” E, as seen in the real estate lease agreement form.

As a result, the Defendants forged 12 copies of the lease contract in the name of 12 lessees, such as G, etc., which is a private document on rights and obligations for the purpose of uttering.

2. On April 10, 2017, the Defendants presented 12 copies of the forged real estate lease agreement to I, an employee in charge of loan who is aware of the forgery at the victim’s office located at H on April 10, 2017.

As a result, the Defendants conspired to use 12 copies of a lease agreement, which is a private document on the forged rights and obligations of 12 lessees, including G, etc.
