1. The plaintiff's appeal is dismissed.

2. Of the instant lawsuit, the part of the claim for confirmation of non-existence of ownership added at the trial.

1. The court of first instance, upon the Plaintiff’s request, accepted the primary claim on the real estate stated in the separate sheet Nos. 1 through 4 (request for cancellation and transfer of ownership), and dismissed the claim for transfer of ownership on the real estate listed in the separate sheet No. 5 to 7.

Since the plaintiff appealed only, the scope of the judgment of this court is limited to the claim for the registration of ownership transfer and the claim for confirmation of non-existence of ownership added in the trial of the court.

2. Basic facts

A. The former Simsi was a village developed B prior to 580 years, and the term “C” was changed to “D” in 1914, and was changed to “A” by the Ordinance of the United States of America on July 1, 1988.

B. In order to promote common convenience, welfare, and friendship, the residents of the Gu and America held a village event with the head of Dong or Ri as the representative of the Dong or Ri.

On January 11, 2015, the community name is referred to as D, E, F, D Saemaeul Association, etc., the name of the Plaintiff, “A Saemaul Association,” a resident of A, and the representative of which is the head.

C. On September 22, 1964, the registration of ownership transfer was completed in the name of “N” under the name of “N” as to the real estate stated in attached list No. 5 of the Daegu District Court’s Office, which was not registered, and the registration of ownership transfer was completed for reasons attributable to October 1, 1961 by the Defendant’s transfer-based U.S. Office (hereinafter “Defendant”) under No. 5111, Sept. 22, 1964.

The defendant completed the registration of transfer of ownership on the real estate listed in the list 6 by the reason that it belongs to October 1, 1961 as the receipt No. 511 of September 22, 1964 by the same registry office.

E. The registration of ownership preservation has been completed in the name of "O" as of September 22, 1964 by the same registry office No. 5127 of the receipt of Sep. 22, 1964 with respect to the real estate stated in paragraph (7) of the attached list, and the defendant has completed the registration of ownership preservation.
