A defendant shall be punished by imprisonment for four years.
Reasons
Punishment of the crime
On October 10, 2006, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Seoul Central District Court on January 10, 2006, and on November 21, 2008, the Seoul High Court sentenced imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Larceny) at the Seoul High Court on November 21, 2008, and was sentenced for three years and six months on February 18, 2012, the record of the larceny of the same kind is more than 13 times.
1. On February 28, 2012, around 12:27, the Defendant habitually stolen: (a) at the “D” restaurant located on the second floor of the building underground in Jung-gu Seoul Metropolitan Government, Jung-gu, Seoul; (b) at the victim E- B B Bable room, and (c) there is a 500,000 won of the market price containing a cash of 50,000 won in the inside money of the victim suffering from his/her will; and (c) at the victim E-Bable room, he/she saws the currency; and (d)
L. A. L. theft was committed.
In addition, from around that time to June 4, 2012, the Defendant habitually stolen another’s property 13 times in total, such as the list of crimes in attached Form 1 (1).
2. On April 13, 2012, around 12:32, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit Business: (a) presented the stolen H’s credit card at the “G” store under the 1st floor of the Gangnam-gu Seoul Metropolitan Government FF Building as if he was his card; and (b) used the stolen credit card by signing on the sales pre-sale slip.
In addition, from around that time to June 4, 2012, the Defendant received property payment from the victimized party by deceiving another person’s credit card that was stolen over a total of eight occasions, such as the list of crimes in attached Form 2, as if he were his card.
