1. The plaintiff's lawsuit against the Gangwon-do District Bus Workers' Union Gangwon-do Branch of Korea;

1. Basic facts

A. The plaintiff is a member of the preliminary defendant association.

B. On April 21, 2016, the members of the National Motor Vehicle Trade Union, the Hanwon Branch, the Hanwon Branch, and the Hanwon Housing Trade Union (hereinafter referred to as the “Gangwon Housing Trade Union”) who were members of the labor union composed of not more than the head of the department, among the employees of the department and lower than the head of the department, decided to dissolve the Hanwon Housing Trade Union and join the preliminary defendant's association. In this regard, the preliminary defendant's association established the defendant's branch composed of the above members as its affiliates

C. On March 20, 2017, the Plaintiff filed an application for provisional disposition seeking perusal and copying of each of the books and documents listed in the separate sheet (hereinafter “each of the books and documents of this case”) with the Defendant Branch under the control of 2017Kahap2007 of this Court.

On June 9, 2017, the Plaintiff and Defendant Branch drafted an agreement with the purport that the perusal of each of the above books and documents is permitted, but the copying is not permitted. Accordingly, the Plaintiff withdrawn the application for provisional disposition on September 21, 2017.

E. The provisions on the inspection of each of the books and documents of this case are as follows.

▣ 노동조합은 노동조합 및 노동관계조정법(이하 ‘노동조합법’이라 한다) 제14조 (서류비치 등) ① 노동조합은 조합설립일부터 30일 이내에 다음 각호의 서류를 작성하여 그 주된 사무소에 비치하여야 한다.

1. List of union members (in case of a trade union in the form of an associated organization, the name of its constituent organization);

2. Union bylaws;

3. A list of names and addresses of executives;

4. Minutes;

(2) The documents referred to in paragraph (1) 4 and 5 shall be preserved for three years.

(2) An auditor of a trade union may, if deemed necessary, conduct an audit of the trade union and disclose the results thereof.

Article 26 (Disclosure of Status of Operation) The representative of a trade union shall be every fiscal year.
