A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around 22:00 on March 15, 2015, the Defendant was driving a B-to-purd vehicle under the influence of alcohol concentration of 0.165% without obtaining a driver’s license in the section of approximately 500 meters from the street in front of the lux of mutual lux extension in Bupyeong-gu Incheon, Bupyeong-gu, Incheon, from around 22:15 to the street in front of the lux of GM treatment 233, as the Bupyeong-gu, Incheon, Bupyeong-gu.
2. On March 15, 2015, at around 22:15, the Defendant: (a) was found to be a drunk driving from the horse in front of the GM treatment set forth in the Bupyeong-gu Incheon Bupyeong-gu, Incheon, in front of the GM treatment 233, and was found to be the Defendant’s birth, the Defendant signed the “D” on the driver’s signature column as the result of the control of drinking driving of a portable information terminal (PDA) prepared in the name of D as if he was the Defendant’s birth; and (b) caused the said C to transmit the results of the control of drinking driving, stating the forged D’s signature, to the traffic police network, thereby forging and exercising the above D’s signature without authority for the purpose of exercising its authority.
3. The Defendant, at the time and place specified in paragraph (2), was required to sign and seal a report on the statement of the driver status of the driver status in the light of the racing at the time and place specified in paragraph (2), as described in paragraph (2), and entered “D” in the name column, and submitted it to C at his own discretion, thereby forging and exercising one copy of the report on the statement of the driver status in the name of D, which is a private document related to the certification of facts without authority, for the purpose of uttering.
4. On March 16, 2015, at around 00:20, the Defendant violated the Road Traffic Act (driving) and the Road Traffic Act (driving without a license) and around 00:33 on the same day, the Defendant did not obtain a driver’s license at a 1k section of blood alcohol concentration from the front side of the light fluence in Incheon Gyeyang-gu, Incheon to the front side of the new fluor apartment in the same Gu.
