The punishment of the accused shall be eight months by imprisonment.

except that the above sentence shall be executed for a period of two years after the judgment becomes final and conclusive.

Punishment of the crime

1. Around 21:00 on October 31, 2019, the Defendant: (a) stored a photo file of his/her driver’s license in the “C” located in Chungcheongnam-si, Chungcheongnam-si; (b) presented it to the staff of a siren enterprise whose name is unknown, and had the said staff enter his/her personal information in the vehicle rental contract; (c) written D in the lessee column; and (d) signed D’s name and attached it to D’s name; and (d) delivered it to the said employee who is unaware of the forged fact.

Accordingly, the defendant, for the purpose of uttering, forged one copy of the vehicle rental contract, which is a private document in the name D, and exercised it.

2. Around November 10, 2019, the Defendant violated the Road Traffic Act (F) and the Road Traffic Act (Free Driver’s License) and the Defendant driven an I-H motor vehicle without obtaining a driver’s license in a section of about 1.8km from the front day of “F” in Chungcheongnam-nam Budget-gun to the front day of “H” in the same military G, and without obtaining a driver’s license in a section of about 1.8km, while under the influence of alcohol concentration of 0.046%.

3. The Defendant signed “D” in the name column of the report on the state of drinking drivers, the report on the state of drinking drivers’ statement, and the notice of the result of the influence control of drinking driving, and issued it to the police officer belonging to the budget district unit of the budget police station who was aware of the forgery.

Accordingly, the defendant forged D's signature for the purpose of exercising the right, and used forged private signature.

4. On November 7, 2019, the Defendant violated the National Health Insurance Act (hereinafter “National Health Insurance Act”) refers to the name and resident registration number of Do resident as if Do resident were to receive insurance benefits for personal damage caused by traffic accidents at the “K Hospital” located in the Chungcheongnam-gun District CourtJ, Chungcheongnam-gun, with the intention of receiving insurance benefits in an unlawful manner, and received insurance benefits by receiving medical treatment.
