[Defendant A] The defendant shall be punished by imprisonment for one year.

However, the above sentence shall be executed for three years from the date this judgment became final and conclusive.

Punishment of the crime

"2019 Highest 438"

1. Around 01:00 on March 8, 2019, the Defendants’ special larcenyed the following: (a) Defendant A operated D 2 truck before the instant house; (b) Defendant B: (c) operated the D 2 truck to the place where the damaged goods were damaged by printing the damaged goods in advance; and (d) Defendant B: (c) putting the victim E, who was the victim’s possession stored at the instant truck, for the purpose of using it in the ginseng dry field development, a grouped of about 1,50 km up to 600,000 won at the market price, which is the victim’s possession stored at the said place; (d) loading of the said truck by carrying the damaged goods, such as loading the damaged goods to D 2 truck; and (e) cutting the goods by means of loading them into the D 2 truck; and (e) around that time, from March 22, 2019 to March 22, 2019.

As a result, the Defendants committed a theft of another's property jointly.

2. The theft of Defendant A;

A. At around 05:40 on February 26, 2019, the Defendant: (a) stolen a victim’s creshion of approximately KRW 500,000,000,000 in the market value of the victim’s possession, he/she stored at the site of Pyeongtaek-si F construction; (b) used the gap in which the victim’s surveillance was neglected; and (c) used the gap in which the victim’s surveillance was neglected; and (d) transferred the victim’s 2 truck

B. On March 10, 2019, the Defendant: (a) around 04:00, at the construction site in the vicinity of H located in Ansan-si; (b) used a gap of approximately 2.80 km of the market value of the victim’s possession, the victim I stored at the same site, which is located in the victim’s bank; and (c) used a gap of approximately 400 km of the market value equivalent to 2.80 km of the victim’s supervision over the victim, thereby cutting off the victim’s truck

"2019 Highest 541"

1. On March 17, 2019, the Defendants’ special larcenyed Defendants: (a) around 01:31, 201, at the L Center operated by the victim K, Kimcheon-si, Kimcheon-si, Defendant B returned to the vicinity of the said store; and (b) by entering the CCTV installed there to the above store, the crime scene was not taken; and (c) Defendant A parked the D Poter in the inside of the said store and kept the D Poter in custody.
