Reasons
Punishment of the crime
[Criminal Power] On July 11, 2018, the Defendant was sentenced to six months of imprisonment for fraud, etc. at the Daegu District Court. The judgment became final and conclusive on April 18, 2019.
[2019 Highest 1043] On February 7, 2019, the Defendant posted a false statement that “E sells gift certificates worth KRW 400,000” on the Internet website in the Defendant’s residence located in Daegu Northern-gu C and D, Daegu Northern-gu, and that “The Defendant will send gift certificates of KRW 370,000 to the victim F, who had contacted and contacted, at the time of remittance of KRW 370,000,00,000.”
However, the defendant did not have merchandise coupons, so even if he received the price from the victim, he did not have the intention or ability to send the merchandise coupons to the victim.
Nevertheless, the Defendant, by deceiving the victim as above, received 3,70,000 won from the victim to the Defendant’s corporate bank account (Account Number G) for the same day as the purchase price of merchandise coupons on the same day, and received a total of 3,390,000 won by the same method over three times from around that time to February 9, 2019, as shown in attached Table 1.
[2019 Highest 1660] On March 6, 2019, the Defendant posted a letter stating “E selling a new world merchandise coupon” on the Internet site at the Defendant’s residence located in Daegu Northern-gu C and Da, Daegu-gu, and then transfers KRW 940,000 to the victim H who contacted with it, the Defendant will send the new world merchandise coupon as a registration.
The phrase “the meaning was false.”
However, the defendant did not have merchandise coupons, so even if he received the price from the victim, he did not have the intention or ability to send the merchandise coupons to the victim.
Nevertheless, the Defendant, as above, by deceiving the victim, received 940,000 won from a corporate bank account (I) under the name of the Defendant on the same day from the victim, and received 940,000 won from the victim, and entered in the list 2 of crimes.
