Punishment of the crime

On June 18, 2007, the Defendant was sentenced to a fine of 4.5 million won for a violation of the Road Traffic Act at the Seoul Northern District Court on June 18, 2007, and on October 2, 2008, the same court has been sentenced to imprisonment for 6 months and 2 years of suspended execution.

1. 2. 모욕 피고인은 같은 날 01:40경 위 고진역 부근 도로에서 위와 같이 음주운전을 하다가 풀숲에 빠지는 교통사고를 발생시켜 사고신고를 받고 출동한 용인동부경찰서 D파출소 소속 경사 피해자 E에게 견인기사 F, 위 파출소 소속 경사 G 등 3명 내지 4명이 있는 가운데 “야, 차 빼, 좆같은 새끼야, 좆같은 새끼들이 세금 받아쳐 먹으면서 이런 것도 안 해주냐”고 욕설을 하여 공연히 피해자를 모욕하고, 이에 모욕죄의 현행범인으로 체포된 후 같은 날 02:10경 용인시 처인구 H에 있는 위 파출소에서 경사 G 등이 있는 가운데 피해자에게 “씨팔 놈아 단독사고잖아, 누구한테 피해줬냐, 짭새 새끼들아, 내가 내일 아침에 차 끌고 와서 쳐 받으면 어떻게 할래, 좆같은 새끼야, 내일 모레 파출소 때려 부수고 가도 못 찾는다, 나는 나갈 꺼니까”라고 욕설을 하여 공연히 피해자를 모욕하였다.
