A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant in violation of the Immigration Control Act is a foreigner who has Vietnam’s nationality and entered the Republic of Korea through the Incheon Airport through the period of sojourn for short-term visits (C-3-91) on April 2, 2019, with the status of stay of short-term visits (C-3-91) until May 2, 2019.

A foreigner may sojourn in the Republic of Korea within the limits of his/her sojourn status and the period of sojourn, and if he/she intends to continue his/her sojourn in excess of the period of sojourn, he/she

Nevertheless, upon expiration of the period of stay on May 2, 2019, the Defendant stayed in the Gwangju Mine-gu by not later than June 15, 2020 without obtaining permission to extend the period of stay.

2. When it is difficult to find a job in the Republic of Korea due to the status of illegal aliens, the Defendant has taken a mind to forge and use an alien registration certificate under the name of the head of immigration office.

On January 20, 2020, the Defendant: (a) introduced “B” in the name of the head of Busan Immigration Office (F-6) in the name of the head of Busan Immigration Office (hereinafter referred to as the “F-6”); (b) conspired with the franchising staff of the franchise group, thereby making a false alien registration certificate under the name of another person who attached the Defendant’s photograph; (c) the Defendant sent his photograph through B; (d) the employee who forged the franchise identification card in the name of the Defendant’s face in the photo column, in the name column, in the name column, in the name column, in the name column, in the name column, in the name column; and (e) printed out the name of the head of Busan Immigration Office (F-6) in the name of the head of the franchise group (01.

Accordingly, the defendant, in collusion with B, forged a certificate of alien registration under the name of the head of Busan Immigration Office, which is an official document, for the purpose of exercising.
