1. The plaintiff's claim is dismissed.

1. Facts of recognition;

A. On June 19, 2009, the Defendant entered into an insurance contract with the Plaintiff listed in the separate sheet (hereinafter “instant insurance contract”) and among them, the main contents of the instant special contract Class II (hereinafter “instant special contract”) are as follows.

The damage (hereinafter referred to as "liability for damage") suffered by an insured worker or his/her spouse living together with such insured worker (hereinafter referred to as "insured") as stated in the insurance policy (certificate of insurance) under Article 4 (Compensation for Loss) by bearing legal liability for the physical disability (hereinafter referred to as "accident") or property damage (hereinafter referred to as "property accident") of another person due to any of the following accidents (hereinafter referred to as "damage") according to this special terms and conditions.

(1) An accident caused by the ownership, use, and management of a house (including movable property and real estate in a site; hereinafter referred to as "house") entered in an insurance policy used by the insured for residential purpose.

(1) The insured shall be liable for the performance of their duties.

B. On June 23, 2014, the Defendant carried out the business of collecting recycled goods with the trade name “C” on the ground of Seongbuk-gu, Seongbuk-gu, Sungnam-si, and around 08:00 on June 23, 2014, in order to remove the drums installed in the clothes warehouse at the said place of business, an explosion accident occurred due to gas in the warehouse while intending to extinguish fire by using the drum and the gas-using drums in order to extinguish fire into the drums installed in the said place of business. As a result, the total warehouse consisting of the recycled sand position board of KRW 30,00,000 at the market price and the drums attached thereto were destroyed or damaged.
