A defendant shall be punished by imprisonment for six months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant is a person who operates a general restaurant in the name of "D" in the name of "D" in the Yongsan-gu Seoul Metropolitan City.
A person who sells or provides agricultural and fishery products or the processed products thereof after cooking shall not cook, sell or provide agricultural and fishery products or the processed products thereof with an indication of origin mixed with the same agricultural and fishery products or the processed products thereof with a different country of origin.
From June 7, 2012 to April 9, 2013, the Defendant purchased the amount of KRW 997.16km (in purchase amount of KRW 9,377,458), KRW 8,500-11,00 per kilogram, and KRW 73 times from June 7, 2012 to April 19, 2013 (Canadian, Germany, Mexico, Mexico, and Luxembourg), KRW 2,938.95 kilograms in swine 6,200 per kg, KRW 7,00 (in purchase amount of KRW 20,02,639), KRW 20,00 per kilogram, KRW 208, KRW 305, KRW 205, KRW 200 (in total of KRW 20,002,639) from around March 29, 2013 (in total of KRW 30,537,505g).
From June 7, 2012 to April 22, 2013, the Defendant: (a) prepared the instant “D” by mixing domestic and imported swine, etc. with 2:8 percent; (b) sold one minute (250g) to unspecified customers for KRW 12,000; and (c) sold approximately KRW 13,500 (3,375 kilograms) by selling approximately 162,00,000 for total amount of KRW 162,00 during the said period.
Accordingly, the Defendant prepared and sold agricultural and fishery products with the country of origin labeled mixed with different agricultural and fishery products.
