1. Purport of claim

The defendant shall pay to the plaintiff 95,592,00 won with 5% interest per annum from January 28, 2016 to the service date of a copy of the complaint of this case, and 15% interest per annum from the next day to the day of complete payment.

The judgment of the first instance is revoked, and the plaintiff's claim is dismissed.

Even if the evidence presented in the first instance court is different from the evidence presented in this court, it is recognized that the facts of the first instance court and the judgment are justifiable.
