Reasons
Punishment of the crime
In February 2014, the Defendant connected the program called “C”, which is a mobile phone displayer, with the name of “D,” and came to know of “D”, and provided communication several times with the victim and stored friendship with the victim, the Defendant was willing to pay off money from the victim if he borrowed money from the victim, or was willing to sell the mobile phone by stealing the victim’s name.
1. On February 10, 2014, the Defendant stated that “I would immediately repay money to the victim when I lend money to the victim in purchasing Nompt.”
However, in fact, the defendant thought to obtain money from the victim by means of stockpiling pro ratas with the victim as above, so even if he borrowed money from the victim, he did not have the intention or ability to pay the money.
Ultimately, the Defendant, by deceiving the victim as above, received 80,000 won from the victim to the City Bank Account under the name of the Defendant, and in such a way, received a total of 18 times as shown in the attached Table 1 of Crimes List 1, and acquired it by deceiving the victim.
2. On May 1, 2014, the Defendant stated, from G located in the Seo-gu Incheon, Seo-gu, Incheon, that “The Defendant obtained consent from male-friendly job offers E, thereby changing the cell phone in the name of male-friendly Gu.”
However, in fact, the Defendant did not have obtained the above E’s consent to opening of the mobile phone, and as such, it was thought that the aforementioned opening of the mobile phone was immediately sold and acquired the price, so even if opening of the mobile phone under E’s name, there was no intention or ability to pay the mobile phone price.
Ultimately, the Defendant, as seen above, by deceiving the victim, prepared an application for joining the mobile phone in the E name on the day from the victim, and received one cell phone equivalent to the market price of KRW 1,067,00 from the victim.
