A defendant shall be punished by imprisonment for not more than ten months.

The defendant shall pay 150,000 won to the applicant for compensation by deceit.

3.2

Punishment of the crime

[2012 Highest 5578] The Defendant: (a) reported the letters of the victims registered on the Internet “D” bulletin board; and (b) received money from the victims; and (c) received money from the victims.

On July 27, 2012, around 14:30 on July 27, 2012, the Defendant: (a) reported the victim’s writing of “new project 610 Telecommunication Modern,” where the victim F was registered on the said bulletin board; and (b) falsely told the victim that “If deposited KRW 55,00,000, the physical movement will be sent as a door-to-door.”

However, even if the defendant receives money, he did not have the intention or ability to send a physical exercise.

The Defendant was transferred KRW 55,00 from July 1, 2012 to August 31, 2012 to the Defendant’s Agricultural Account (G) by the same method as indicated in the annexed Table of Crimes (1) in the same manner, including the transfer of KRW 6,462,50 from July 1, 2012 to August 31, 2012.

Accordingly, the defendant was provided property by deceiving the victims.

[2012 Highest 6410] The Defendant: (a) reported the letters of the victims registered on the Internet “D” bulletin board; (b) received money from the victims; and (c) received money from the victims.

On August 30, 2012, around 12:30 on August 30, 2012, the Defendant: (a) reported the victim’s wishes to galthois 7.0 to purchase the galthois 7.0 on the above bulletin board; and (b) made contact with the victim, and sent the device by door if deposit KRW 110,000 is made.”

However, even if the defendant received money, he did not have the intention or ability to send the money.

The defendant acquired 110,000 won from the victim to the Daegu Bank Account (I) of the defendant.

[2012 Highest 7103] On April 27, 2012, the Defendant purchased 'Internet K site' with access to the Internet K site at the scam of the J in Daegu-gu Seoul Metropolitan City.
