All of the prosecutions of this case are dismissed.
Reasons
1. The Defendant, at the request of the victims who have been liable for an amount equivalent to KRW 1.9 billion, terminated the establishment of the right to collateral security established on the building owned by the victim B to secure the above obligation, and the victims could not have been able to recover without having received the Defendant’s telephone, and the victims could not be forced to keep the Defendant on the ground that all of the documents were returned even after sending the certificates of contents, and the victims could be punished.
On October 31, 2019, the Defendant sent text messages to the victim C at the Defendant’s residence located in D on October 31, 2019, with the victim’s cell phone number (E), that “it is the last day of the late notification of the increase, which is the most difficult attorney-at-law who has been appointed. However, if the F building auction is disposed of, then the Defendant sent text messages to “Mara (afterma) with the knowledge of the completion of the claim of B when the F building auction is disposed of,” and then the Defendant threatened the victim by sending text messages to the victim nine times from that time to March 27, 2020, such as the list of crimes (1).
B. The Defendant sent text messages to the victim B, at the time, at the place specified in paragraph (1), and at the victim’s cell phone number (G) number, to the victim’s cell phone number, stating that “whether or not there was any error in the process of criminal litigation or not having been filed in the form of fraud or not, in the process of civil litigation, the victim’s cell phone number was transferred to the treatment jumma address where the chests did not have the chest, and it was found that he was unable to get the pain, and that he would stop the way for the end of the NAEs.” The Defendant sent text messages from that time to March 27, 2020, and threatened the victim by sending text messages to the victim at least eight times as indicated in the list of crimes (2) in attached Form No. 2.
