A shall be punished by imprisonment with prison labor for two years, for two years, for two years, and for one year and six months, for each of them.

Punishment of the crime

1. From June 2013 to April 2015, Defendant A, as the representative director of a corporation M (hereinafter “M”) with specific heat-using machinery and equipment with the head office (hereinafter “head office”) located in Ulsan-si L, Ulsan-si, Ulsan-si, for the purpose of manufacturing revolving machinery and recycling new energy projects, etc. overall tasks of the company as the representative director. Defendant B, from May 2012 to April 2015, has overall control over the company’s duties. Defendant B, as the auditor of M and Young-si N.

As the president of the Mcheon Research Institute (hereinafter referred to as the “Ycheon Research Institute”), he/she has overall control over the progress of major economic sphere development tasks. From August 2010 to April 2015, Defendant C has overall control over the management and execution of the company’s funds as the head of M’s management team. Defendant D worked as a researcher of the Youngcheon Research Institute from November 201 to April 2015, 2015, and was in charge of the real-time integrated research cost management system (Real-Mesocas Management (hereinafter referred to as “RCm”) introduced in 2013 related to the development of major economic sphere technology and the disbursement of research funds. From January 20, 2010 to June 20, 2015, Defendant D purchased the MM Team as its production team from around 10 to 20 June 21, 2014, respectively.

2. The Defendants’ crime M is selected as a major institution for Q “P” task, a metropolitan economic zone leading project promoted by the Minister of Knowledge Economy on May 1, 2012 (hereinafter “large-scale Economic Zone”), and concluded the Convention on the Support of Large-Scale Economic Zone Leading Industry Promotion Project (Development of Technology), a foundation affiliated with the Korea Industrial Technology Promotion Agency, which performs the business selection, follow-up management, supervision, and evaluation upon delegation of the said project from the Knowledge Economy Department, to enter into an agreement on the Support of Large-Scale Economic Zone Leading Project (Development of Technology), thereby using 1.4 billion won each year from May 1, 2012 to April 30, 2015 (one hundred million won each year, being paid to the participating institution), with the Government’s contribution of the 1.4 billion won each year from May 1, 2012 to April 30, 2015.
