Reasons
Punishment of the crime
1. Defendant A is a person who works as a joint representative director of E Co., Ltd. (hereinafter “E”) from December 16, 201 to June 30, 2015 and has overall control over the management of the company, such as a business contract and fund execution.

B A served as a director of E from October 2012 to June 2016, 2016, and was in charge of marketing, investment, financial loans, etc., and was a representative director of E (hereinafter “D”) for the groas container sales company in which E invested.

C From December 16, 2011 to June 30, 2015, as the joint representative director of E, he/she was in charge of the operation of the company, such as technology development. From July 1, 2015 to July 1, 2015, he/she is a person who works as the sole representative director of the said company.
E is a company that engages in software development, supply business, etc. in Sungnam-si, Sungnam-si F (referring to G from Sungnam-si to September 24, 2015 and to H from September 6, 2016).
2. Defendants A, B, and C’s joint criminal acts (the occupational embezzlement of government subsidies) operated by the Defendants
E as a part of the government's civil-military technological cooperation project, E was selected as a research institute in charge of the I's project (hereinafter "the project in this case") under the name of the head of the defense project (the head of the civil-military cooperation promotion institute established in the National Defense Research Institute pursuant to the Promotion of Civil-Military Technical Cooperation Projects Act) and entered into an agreement with the Agency for Civil-Military Cooperation in the Agency for Defense Development, which is an institution exclusively in charge of the project in this case, on June 12, 2014.
The technical use of the Convention executed to carry out the instant project is comprised of KRW 750 million with government contributions of KRW 750 million with KRW 250 million with the private financing of KRW 250 million with KRW 40,000,000 with KRW 419,090 with the private financing of KRW 130,6260,000 with KRW 55,5350,000 with the government contributions of KRW 419,000 with KRW 13,6260 with the private financing of KRW E
Defendants are entitled to technical research funds under the above Convention.
