Defendant
A shall be punished by imprisonment for three years and by fine for 70,00,000 won, by imprisonment for two years and by fine for 40,000,000 won, respectively.
Reasons
Punishment of the crime
1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bribery) against the Defendants, acceptance of a third party bribe against Defendant B, and acceptance of a bribe against Defendant A
A. The Defendants’ status and duties were appointed as H on December 29, 1989, and around June 4, 2005, Defendant B took overall charge of the duties related to the I Research Department, including purchase of goods necessary for research and research, upon being issued as the head of the I Research Institute of Basic Science Support to the Republic of Korea as the head of the I Research Institute. On February 8, 2010, the indictment appears to be written as “ February 28, 2010,” but it appears to be a clerical error.
(Evidence) From around May 23, 201 to around May 23, 2011, Defendant A was appointed as H of the Korea Basic Science Support Institute on February 26, 1996 and was promoted to K on March 1, 2006 and around March 1, 2012, and performed duties such as ordering goods necessary for research and examining whether supplied goods have been supplied normally as contract terms.
In addition, from June 1, 2009 to May 31, 2010, Defendant B was under the control of the Korea Basic Science Support Institute from around June 1, 2009, and was in charge of the development of the O analysis system (the research period: from June 1, 2009 to May 31, 201), which is the Small and Medium Business Administration Support Project (the research period: from June 1, 2009 to May 31, 201), and Defendant A was in charge of the above research task from around June 1, 201 to around May 31, 201, Defendant B was in charge of the above research task, including purchase of goods.
B. Defendant B received goods from M on or around December 2007, and came to know M’s transfer Q, etc., and around May 2009, Defendant B participated in the “O analysis system development in which the Defendant is a task manager.”
