A defendant shall be punished by imprisonment with prison labor for not more than ten months and by a fine not exceeding five hundred thousand won.

Punishment of the crime

1. The Defendant is a person who is engaged in driving a BMW X5 car in violation of the Road Traffic Act (not after the accident) and the Road Traffic Act (not after drinking).

On September 3, 2016, the Defendant driven the above vehicle while under the influence of alcohol of 0.149% in blood around 08:05, while driving the vehicle at a 0.149% alcohol level, and the two-lane roads in front of the tunnel No. 30 Namsan 3, Yongsan-gu, Seoul Special Metropolitan City, along the 25-lane roads in front of the tunnel No. 30 Namsan 3, the southsan 3-do road was driven at an insular speed in accordance with the two-lane of the road.

In such a case, a person engaged in driving of a motor vehicle has a duty of care to prevent accidents in advance by operating the steering gear accurately by properly operating the steering gear while living well on the front side and the left side.

Nevertheless, the Defendant neglected this and operated the steering gear to the right side of the instant BMW X5 vehicle due to the negligence of operating the steering gear to the right side of the said tunnel, and was assigned to the boundary stone and course installed on the right side of the said tunnel.

Ultimately, the Defendant did not immediately stop the above distribution box and BMW X5 waves due to the above occupational negligence and did not take measures, such as arranging the site and stopping on the road, but escaped without leaving BM X5 vehicles and strikes.

2. On September 3, 2016, at around 08:33, the Defendant: (a) taken video images of the Defendant, who was faced with this disturbance on the road before the D police box located in Yongsan-gu Seoul Metropolitan Government F; and (b) taken the victim slope E (44) of the Yongsan Police Station D police box affiliated with the Yongsan Police Station D police box; and (c) taken the victim slope E with the victim’s assistant.
