1. The plaintiff's appeal is dismissed.

Reasons

1. The reasoning for the court’s explanation concerning this case is that the Defendant, at the time of the instant sales contract, agreed to divide approximately 4,000 square meters, including part 7,541 square meters and part 723 square meters as indicated in the annexed drawings, among the forest land of this case, as an intermediary fee, and agreed to transfer the ownership of the pertinent land by dividing it into about 7,541 square meters and 723 square meters as indicated in the annexed drawings, and the testimony by the witness Q of the trial of this case is as stated in the reasoning for the judgment of the first instance, except for adding the following judgment to the third part after the fourth decision of the first instance, it is consistent with the reasoning for the judgment of the first instance.

[Additional Parts] Furthermore, even if the Plaintiff agreed with the Defendant at the time of the instant sales contract, as alleged by the Plaintiff, to transfer ownership of approximately 4,000 square meters, including “2, 400 square meters” as indicated in the separate drawings, among the forest land of this case, under the title of brokerage commission, the agreement between a non-licensed real estate agent and conducting real estate brokerage business without registering the establishment of a brokerage office, shall be null and void in violation of the former Real Estate Brokerage Act (wholly amended by Act No. 7638 of July 29, 2005) (see, e.g., Supreme Court Decision 2008Da7519, Dec. 23, 2010). Since there is no dispute between the parties, or in full view of the purport of testimony as stated in Gap evidence No. 1, Q of the trial witness, the Plaintiff entered into the instant real estate brokerage contract without the qualification of the real estate agent after registering the establishment of the real estate brokerage office, and without the qualification of the Plaintiff.
