Defendants shall be punished by a fine of KRW 5,000,000.

In the event that the Defendants did not pay the above fine, the fine shall be respectively imposed.

Reasons

Punishment of the crime

No person who intends to run a brokerage business of 2019 High-level 1800 shall run a brokerage business without filing a registration of establishment of a brokerage office with the head of a Si/Gun/Gu having jurisdiction over an area where he/she intends to establish a brokerage office.

1. Around May 26, 2018, the Defendant and B received brokerage fees from D around September 13, 2018, respectively, from D and around October 2018, without registering the establishment of a brokerage office to the head of the competent Gu as a licensed real estate agent, at the seller D’s home located in Dongjak-gu Seoul Metropolitan Government, as a broker for a real estate sales contract for Dongjak-gu Seoul Metropolitan Government between the buyer and D, and from D around September 13, 2018.

2. Around May 28, 2018, the Defendant and B, without a licensed real estate agent’s qualification, arranged a real estate sales contract for G in Dongjak-gu Seoul Metropolitan Government between the seller F and buyer at the coffee shop near the Dongjak-gu Seoul Metropolitan Government, and received the brokerage commission from E on September 13, 2018, and around October 29, 2018, respectively.

Accordingly, the defendant, in collusion with B, carried on the brokerage business without registering the establishment of the brokerage office.

No person who intends to run the brokerage business shall run the brokerage business without filing a registration of establishment of a brokerage office with the head of a Si/Gun/Gu having jurisdiction over an area where he/she intends to establish a brokerage office.

1. Around May 26, 2018, the Defendant and A received each brokerage commission from D around September 13, 2018, from the seller D and buyer E to the seller’s house located in Dongjak-gu Seoul Metropolitan Government, as a broker for the real estate purchase and sale contract for Dongjak-gu Seoul Metropolitan Government C, and around October 2018, respectively, without registering the establishment of a brokerage office to the head of the competent Gu as a licensed real estate agent.

2. The Defendant and A are not qualified as a licensed real estate agent and thus have not registered the establishment of a brokerage office to the head of the competent Gu on May 28, 2018, Dongjak-gu Seoul.
