A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
From November 2014 to April 2015, the Defendant: (a) was the trade name of “C”; (b) from May 2, 2015 to March 2016, the person who was operating a mobile phone sales store under the trade name of “E” located in the territory of Cheongju-si from May 2015 to March 2016; and (c) was in possession of personal information, etc. of customers who opened a mobile phone at the said sales store; and (d) was in mind of raising profits by arbitrarily opening a mobile phone in the name of the said customers.
1. Forgery of private documents and the uttering of a falsified investigation document;
A. On August 27, 2014, the Defendant forged a private document: (a) around August 27, 2014; (b) was previously aware of it;
Using F’s personal information to “T Service New Contract” which is kept in the place, written “G906S Gad,” “F”, “G”, and “F” in the resident registration number column, and “G”, and “F” on the applicant customer column, and signed on the next page on the mobile phone model name column.
As a result, the Defendant forged an application form for joining a mobile phone in F’s name, which is a private document on rights and obligations, for the purpose of uttering, and forged an application form for joining a mobile phone 45 times from around that time to January 8, 2016, such as the first time table of crimes in attached Table 1.
B. On August 27, 2014, the Defendant exercised an application for subscription to a cell phone which was forged on 45 occasions from around that time to January 8, 2016, by delivering the forged mobile phone application form to the employees of SK Telecom Co., Ltd., who knew of such forgery as above, as if the application form for subscription was duly formed.
2. Fraud;
A. On August 27, 2014, the Defendant: (a) around August 27, 2014, filed an application for joining the F mobile phone in the above F name; (b) issued the victim SK Telecom Co., Ltd.’s application for joining the mobile phone and filed an application for joining the mobile phone.
However, it is true.
