1. The plaintiff's appeal is dismissed.
2. The costs of appeal shall be borne by the Plaintiff.
The purport of the claim and appeal is the purport of the appeal.
Reasons
1. Facts of recognition;
A. On December 9, 2015, the Plaintiff, the owner of multi-family housing E located in Sejong Special Self-Governing City (19 households; hereinafter “multi-household housing in this case”) signed a contract for consignment sale of communications goods with the Defendant’s agency B Co., Ltd. (hereinafter “non-party agency”) and signed a contract for consignment sale of communications goods, and issued to C and D (hereinafter “the instant operator”) a written application for use of LG U Internet and TV service organization (hereinafter “application 1”) stating the details of “each multi-household housing in this case, 40,000 won (excluding value-added tax; hereinafter the same shall apply) for the instant multi-household housing.”
B. However, in order to open the instant multi-unit line on the wind that has already been used by all CORE in the studio near the instant multi-household house, the Defendant was required to re-enter the instant multi-unit line from the Defendant’s national office (the place where equipment to provide telecommunications services is installed). Accordingly, the Defendant notified the instant multi-unitr through the Nonparty’s agency that the contract cannot be concluded and the amount should be added.
C. Since then, F, the team leader affiliated with the Nonparty’s agency, drafted an application for the use of the instant multi-household service organization on January 27, 2016, stating the following: U 23 lines, the sum of monthly charges of KRW 177,100, U TV 23 lines (the first line shall be distributed in tVG and 22 lines), the sum of monthly charges of KRW 102,70,700, each room Wifi installation, automatic transfer, etc. (hereinafter “second application”).
After the Defendant performed optical cable construction in the instant multi-household housing in accordance with the application for the 2nd application, the Plaintiff shall open and process LG U Internet and TV services products as of January 27, 2016 to January 26, 2019.
