1. The plaintiff's claim is dismissed.

1. Basic facts

A. 1) F Co., Ltd. (hereinafter “F”)

(1) As a special purpose corporation established to subsidize the operating expenses of H in G, the “J hotel” opened in I around September 2014 (hereinafter “instant hotel”) is a “J hotel.”

2) Around July 10, 2014, F established K Co., Ltd. (hereinafter “K”) with a 100% subsidiary around July 10, 2014, and thereafter K leased and operated the instant hotel from F.

3) The Plaintiff is a F’s employee (the team leader) and K’s representative (the representative director). 4) The Defendant is a media company that reports news, etc. through terrestrial broadcasts, Internet website, etc.

B. Defendant’s report 1) On March 30, 2016, the Defendant reported the news of “M” in the L “L” program as indicated in attached Table 2, and posted the said news on the Defendant’s website (hereinafter “instant report”).

(2) On March 31, 2016, the Defendant reported the news of the same content as that indicated in attached Table 3 as “N” in the L “L” program, and posted the said news on the Defendant’s website.

(3) On March 31, 2016, the Defendant reported the news of the same content as attached Table 4 in the “L” program as “O” and posted the said news on the Defendant’s website (hereinafter “the third report of this case”).

2. The Plaintiff’s assertion is lawful and lawful in accordance with the internal regulations, etc., and the hotel and guest room of the instant case were used.

Nevertheless, the Defendant reported to the effect that the Plaintiff used the hotel restaurant and guest room by unlawful or unjust means while inflicting damages on the hotel of this case through the first or third reports of this case (hereinafter collectively referred to as “each of the instant reports”).
