Punishment of the crime

[2016 Go fixed 2281] The Defendant posted a letter to sell “LG X-140 Netbuk” by accessing the Internet’s trading site at a place where it is difficult to know the place around March 30, 2016, and then, reported it to the victim B who contacted with it.

“The purpose of “ was to make a false representation.”

However, even if the defendant did not possess the above net north and received the payment from the injured party, he did not have the intention or ability to sell the net north.

As such, the Defendant, by deceiving the victim and receiving 50,000 won from the victim’s new bank account under the name of the Defendant on the same day, and from March 11, 2016, the same year.

4. From around September 19, the victim acquired the total sum of KRW 1,353,00 through 11 times in total as the price for the goods from 11 victims as shown in the attached list of crimes.

However, in fact, the Defendant did not have any goods to be sold, and was thought to be used for living expenses even if he received the money from the injured party, and thus, the Defendant did not have any intention or ability to sell the goods to the injured party

Ultimately, the Defendant, by deceiving the victim as such, received KRW 63,00 from the victim to the new bank account in the name of the Defendant on the same day from the victim, as the price for the goods. From March 11, 2016 to April 18, 2016, the Defendant received KRW 305,000,000, in total, from five times in the same way as indicated in the attached crime list.
