A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On May 19, 2017, the Defendant posted a false statement stating that he would send a mobile phone to the victim F, who reported and contacted the above writing, using a computer in the EPC room located in Seongbuk-gu, Seongbuk-gu, Seongbuk-gu, Sungnam-gu, stating that he/she would send a mobile phone if he/she remitted the price to the victim F.

However, since the defendant did not have a mobile phone, there was no intention or ability to send a mobile phone even if he receives the payment from the damaged person.

As above, the Defendant: (a) deceiving the victim as above; (b) received money from the victim to the new bank account (G) in the name of the Defendant in the name of the victim for the same day; and (c) deceiving the victims by the same method nine times in total from around that time to July 31, 2017; and (b) deceiving the victims by the same method; and (c) deceiving them from the victims total of KRW 2,575,000.

1. On May 14, 2017, the Defendant: (a) connected “EPC” room located in Seongbuk-gu, Seongbuk-gu, Sungnam-gu, with a cell phone to “H (H)”; (b) posted a false statement to the effect that “I sell Aphone 6s”; and (c) reported the statement to the victim I, “I will send Aphone 6s to I on their own when remitting the proceeds of goods.”

However, since the defendant did not have 6 sonphones, there was no intention or ability to sell it.

As such, the Defendant, including by deceiving the victim and receiving KRW 300,000 from the victim I to the new bank account (J) in the name of the Defendant, received the total amount of KRW 4,570,000 from around March 28, 2017 to July 27, 2017 by means of the same 17 victims, as shown in the List of Crimes.
