피고인들은 2016. 9. 25. 23:00경 구미시 D 소재 E식당에서 술을 마시던 중 다른 테이블에 있던 피해자 G(여, 37세)가 피고인 B의 과거 남자관계에 관한 말을 하였다는 이유로 화가 나 피고인 A은 손으로 피해자의 뺨을 2회 때리고 발로 옆구리를 2회 차고, 피고인 B은 손으로 피해자의 얼굴, 머리 등 전신을 주먹과 손바닥으로 수십 회 때리고, 피해자의 머리채를 잡아 바닥으로 끌어내린 다음 발로 피해자의 몸통 부위를 수 회 걷어 찼다.
