[Final Judgment that constitutes a single concurrent crime after Article 37 of the Criminal Act] Defendant A was sentenced to a two-year suspended sentence of imprisonment with prison labor for a reason of fraud, etc. on November 30, 2016 in the early branch of the Chuncheon District Court, and the judgment was finalized on December 8, 2016.

[2] Defendant A, as the representative director of a corporation B established for the purpose of providing services, etc. using ten full-time workers with the head office in Gangwon Yangyang-gun D, has overall control over matters concerning the safety and health of its employees. 1. The business owner of a defendant A shall take measures necessary to prevent any danger in the course of his/her work at a place where his/her employees might fall down, soil and sand structures, etc. might collapse, where material objects might fall or come by flying off, or where other danger may occur due to natural disasters in the course of his/her work;

In addition, business owners shall install the protective devices, such as safety railing, fences, vertical fall telescopes, or covers, at places where workers are at risk of falling, as the end or opening of the work plate and passage, and have sufficient strengths, and in cases of installing a cover, they shall be installed so as not to cover it or fall off, and shall indicate that they are the opening part so as to be recognizable at the open place.

In addition, if the business owner wears a safety string at a place with a height of at least two meters that is likely to fall down, he/she shall install equipment, etc. to use safe strings.

Nevertheless, the Defendant, at around 20:00 on April 30, 2015, had G workers employed by Company B ( South and 55 years old) from F located in Kang Changwon-gun E (Seoul) to inspect electric installations.
