A. The previous 5164 square meters of the C before the subdivision was owned by the Plaintiff. On April 17, 1991, the Plaintiff divided the said land before subdivision into three hundred and seventy-eight square meters (hereinafter “C land”) in Jeju-si, Jeju-si, Seoul-si, and four hundred and seventy-eight6 square meters (hereinafter “D”) prior to Jeju-si, and the Plaintiff donated C land to Nonparty E and F, who are children, on June 28, 2000.

나. 원고는 1983. 7. 4.경 원고의 아버지인 망 G를 대리인으로 하여 소외 H와 사이에 도급계약을 체결한 뒤 원고의 비용으로 이 사건 분할 전 토지 지상에 건물을 신축하고 1983. 9. 16. 준공하였으며, 그 후 위 건물은 1991. 8. 24.경 증개축되어 오면서 현재 C 토지 및 D 토지 지상에 주문 제1항 기재 ㉮부분, ㉯부분, ㉴부분(이하 ‘이 사건 건물’이라 한다)과 같이 존재하고 있다.

다. 피고는 망 G와 혼인관계에 있던 자(즉 계모)로서 1991. 4. 10.경 이 사건 건물에 전입하여 망 G와 함께 이 사건 건물에서 거주하여 왔고, 이 사건 건물에서 거주하며 이를 사용하여 오는 과정에서 주문 제1항 기재 ㉰부분, ㉱부분, ㉲부분, ㉳부분, ㉵부분을 간이창고나 가건물 형태로 개축하거나 기존 건물인 이 사건 건물에 증축하여 사용하여 오고 있다.
