Reasons

Punishment of the crime

1. From March 12, 2014, the Defendant, with the acquisition of credit cards, conspired with the victim Samsung Card Co., Ltd. (hereinafter “victim Co., Ltd.”) who was holding a credit card (credit card No. D) issued by the victim Samsung Card Co., Ltd. (hereinafter “victim Co., Ltd.”) in the name of the former husband, resulting in loss of the credit card No. 3, thereby deceiving the victim Co., Ltd. to be reissued.

The Defendant, around April 7, 2014, ordered a person whose name is unknown, to walk a phone to the victim company, and make the victim company go through C, and caused E, an employee of the victim company, to make a false statement that “the credit card was lost, so issued again, and sent it to F at the original week.”

The Defendant had the victim company send one Samsung Card in the name of C to F in the Won-si, the Defendant’s residence, and was issued through the House G around April 9, 2014.

Accordingly, the defendant received property from the victim in collusion with a person whose name is unknown.

Fraud due to the use of a credit card and the Defendant of the Specialized Credit Financial Business Act, on April 9, 2014, the Defendant, at the I restaurant operated by the victim whose name is unknown at H on April 9, 2014, presented the credit card acquired property profits equivalent to the same amount by presenting the said amount as the card duly issued, while settling the meal amount of KRW 9,00,00, which was executed by the victim, as if he was the card duly issued, and used the credit card acquired by deceiving the victims, from May 30, 2014 through the foregoing method until May 30, 2014.
