A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. On July 1, 2015, the Defendant: (a) forged private documents; and (b) forged the said investigation documents; (c) on July 1, 2015, at the “F office’s place of the Defendant’s operation located in Seocho-si, Seocho-si; (d) “The location of real estate: 182.46 square meters of the general steel structure retail store at 182.46 square meters of the general steel structure at 2-dong general building at Haju-si;” (c) “the contractual terms: 150 million won; (d) monthly rent of KRW 7 million; (d) monthly rent of KRW 1.5 million; (e) the monthly rent was determined on a deposit basis on August 1, 2015 (from August 2015; (e) the lease period was determined as the “real estate lease agreement” in the name of the lessor and the seal affixed to the lessor’s resident registration number 7 years from the date this was forged; and (e) the lessor’s name and seal attached to H 1.
2. Forgery of private documents, uttering of a falsified investigation document, and evasion of compulsory execution on December 7, 2015;
A. On December 7, 2015, the Defendant forged a private document, or exercising the aforesaid investigation document, stated in the column for the location of the real estate in the site for the commercial lease (monthly rent) contract at the above location “J, 101 (1) Dong),” in the column for deposit, “5 million won” in the column for deposit, “4.5 million won” in the column for the term of existence, and “on December 15, 2015 and June 30, 2020.” In the column for the date of preparation, the Defendant stated in the column for the leased property “K, 102 Dong 1201, L, M, and H” in the name of the lessor and issued the leased property at the same location as the date of the lease agreement, and additionally forged the agreement at the same time and issued the same 20th anniversary of his/her name by means of the foregoing method, and forged the agreement at the same time and delivery to H 1, 2012.”
B. The Defendant is evading compulsory execution on July 29, 2015.
