A defendant shall be punished by imprisonment for not less than eight months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant served as a general manager in C from March 2012 to December 2012 as a worker dispatch business entity, and D (Suspension of Prosecution on the same day) is the representative of C.
1. Forgery of an official document;
A. Although the Defendant, along with D, failed to obtain permission for temporary work agency business, the Defendant was willing to forge a permit for temporary work agency business as if it obtained permission for temporary work agency business from a customer.
The Defendant, around June 2012, entered the name or the name column of another company’s permission for temporary work agency business by using a computer in the name or corporate name that was stored in the USB from the office of the Co., Ltd. office located in the fourth floor E of Ansan-gu, the Defendant: “(State)C”; “D” in the location column; “G” in the resident registration number column; “G” in the period column; “from June 5, 2012 to June 4, 2015; “the principal place of business” in the business column; “The fifth day of June 2012”; and “the Administrator of the Incheon Employment and Labor Branch” in the license column; and “D” in the license column, puts the official seal of the Administrator of the Incheon Employment and Labor Branch that was stored in the file form; and D has observed the Defendant’s forgery of the temporary work agency business license.
Accordingly, the defendant, in collusion with D, forged one copy of the permission for temporary work agency business to (State) C, which is an official document, in the name of the head of the astronomical Labor Site Office.
B. The Defendant, along with D, had the intent to forge the permission for temporary work agency business as referred to in the above paragraph (a) and the Defendant used a computer in the trade name or corporate name column of another company which stored in the USB at the same date, time, place as referred to in the above paragraph (a) and in the location column, “(C)”, “D” in the name of the representative column, “G” and “G” in the resident registration number column, “from June 5, 2012 to June 4, 2015” and “the current status of the place of business.”
