A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
C In around the end of 2012, it was ambiguous to operate the fraud group of the former generation by forging a third party's resident registration certificate and a lease contract with D, thereby obtaining a loan from a financial institution as security or acquiring bonds from an individual.
C is in charge of the overall operation and direction of the above fraud group, such as fabrication of various contracts, inclusion of fake lessors and those who will engage in the execution of fake lessees, withdrawal and distribution of profits, and D takes charge of the role of introducing bonds to C, E is in charge of forging resident registration certificates at the request of C, and F is in charge of forging resident registration certificates, and F is in charge of the management and withdrawal of offices of fake lessees or fake lessors, and the Defendant A is engaged in the conduct of a fake.
1. Around May 27, 2013, the Defendant and F: (a) at the office of H Licensed Real Estate Agent located in Seodaemun-gu Seoul Metropolitan Government, and (b) at the office of the lessor in accordance with C’s instruction, and (c) at the office of the lessor in accordance with C’s direction; (b) F, while the lessee was working for a lessee, the Defendant submitted to the staff in charge that “Seoul Seodaemun-gu K Apartment 107, 204,” “240,000 won in the deposit column; (c) “240,000 won in the deposit column”; (d) from June 4, 2013 to June 4, 2015, the lessor’s personal information was written in the lessor column; and (d) the lessor’s personal information was written in the lessee column; and (e) I stamped stamped’s seal affixed to C following the name of J; and (e) submitted it to the staff in charge who was unable to know the forgery.
Accordingly, the Defendant and F, in collusion with C, I, etc., forged a set of the lease contract in the name of J on May 27, 2013, which is a private document related to rights and obligations, and exercised it.
2. C around May 2013, upon introducing the victim M from L around 2013, the injured party was committed by the lessor N, and the Defendant was committed by the lessee with the leased contract forged by C as security.
