Reasons
1. Facts of recognition;
A. The Plaintiff is a management body established with all sectional owners of Seocho-gu Seoul Metropolitan Government Building A (hereinafter “instant building”) as members, as prescribed by the Act on the Ownership and Management of Aggregate Buildings.
B. On May 19, 201, the Defendant purchased No. 103 of the underground floor of the instant building (hereinafter “instant store”) in the course of voluntary auction.
C. From September 2012 to December 2013, 2013, the Defendant did not pay to the Plaintiff the management expenses of the instant store (hereinafter “instant unpaid management expenses”) as indicated in the “unpaid amount” column as follows.
According to the plaintiff's regulations, a sectional owner of the building of this case is obliged to pay the unpaid amount at the rate of 5% per month until three months after the delay in payment of management expenses, and the late payment charges calculated at the rate of 2% per month thereafter.
The late payment charge incurred as of the date of filing the lawsuit in this case with respect to the unpaid management expenses of this case shall be recorded as follows:
5,390,020 for September 15, 2012; 358,950 for October 2012; 355,920 for January 3, 2012; 352,460 for December 36, 2012; 359,200 for May 36, 2013; 360 for June 36, 2013; 360 for May 36, 201; 360 for May 36, 201; 360 for June 36, 201; 40 for May 36, 201; 360 for June 3, 2013; 40 for May 36, 206; 360 for June 36, 2013; 40 for May 38, 2013;
2. Determination:
A. According to the above facts, the defendant's total sum of 6,668,210 won of the unpaid management expenses and late payment fees in this case = Total of 5,401,530 won of the unpaid management expenses in this case.
