Punishment of the crime
"2013 Highest 1742" means that the defendant obtained a certificate of personal seal impression and a copy of resident registration from the victim D, who is an infant of his living together, with the intent to obtain a loan by establishing a mortgage on real estate owned by the victim who stolen the certificate of personal seal impression and the certificate of resident registration.
1. A thief, around June 13, 2010, the Defendant stolen the victim’s seal imprint and registration certificate, which are the victim’s ownership, by taking out his/her seal imprint and registration right, at the house of Dongwon E apartment-gu, 504 and 203, Dongwon-gu, Sinsan-si, Gyeonggi-si, and by taking advantage of the crepans without victim D.
2. Forgery of private documents;
A. On July 5, 2010, the Defendant: (a) at the certified judicial scrivener G office located in Songpa-gu Seoul, Songpa-gu, Seoul, using a computer located therein to indicate the real estate of the power of attorney, “the indication of a building; (b) H; (c) Dong; and (d) the indication of a building located in the section for exclusive use: A-2-205; (c) the structure: reinforced concrete manufacture and size; (d) the second floor area; (d) the indication of land subject to the site ownership; (e) the Gyeonggi-do, the members of Ansan-si, the Gyeonggi-do, the land size; (b) the ownership and site ownership ratio: (d) the ownership and site ownership ratio: 4238.4.46”; (c) the establishment of mortgage right on July 5, 2010; (d) the establishment of mortgage right on the top section of the registration; and (d) the establishment of a 30,000 apartment house and the 40,050,000-4,00-4,0.
Accordingly, for the purpose of uttering, the Defendant forged a letter of delegation in the name of D, a private document related to rights and obligations.
B. The Defendant prepared a form of the certificate of borrowing using a computer located at the time and place set forth in paragraph 2(a) and prepared the form of the certificate of borrowing with a black pen.
