Defendant
A shall be punished by imprisonment with prison labor for eight months and by imprisonment for four months.
However, this judgment is delivered against Defendant B.
Reasons
Punishment of the crime
1. Defendant A
A. On July 2010, the defrauded concluded that “The Defendant, at the office of the victim E, who is located in Ansan-gu, Mayang-gu, Synyang-gu, Synyang-si, the victim, “The Defendant did not meet the funds to engage in the scrap metal business. If B, the Defendant would have an investment to obtain a few times of profits rather than inserting money in the bank.”
However, even if the defendant received money from the victim, he did not have the intention or ability to use it for the scrap metal business.
On August 18, 2010, the Defendant, by deceiving the victim as such, received KRW 10 million from the victim to the Defendant’s new cooperation account (F).
In addition, from around that time to February 23, 201, the Defendant received a total of KRW 29.5 million from the victim on seven occasions as stated in the list of crimes in the attached Table.
Accordingly, the defendant was delivered KRW 29.5 million by deceiving the victim.
B. Around November 18, 2010, the Defendant: (a) at the Defendant’s house located in 302 of the Yongsan-gu G building in Ansan-si; (b) using a computer installed in the place; (c) the title is “a sales contract for recycled scrap”; (d) the location of the object: H, name, and address of the seller: Ansan-si in Gyeonggi-do; (c) the seller’s name and address: the member of the Dong-gu in Ansan-si in Gyeonggi-do; (d) the seller’s name and address; and (e) the seller’s seal was affixed to the seller’s name and then printed out; and (e) the seller’s seal was affixed in advance to the seller’s name, which is a private document on his/her rights and duties. Accordingly, the Defendant forged one copy of the sales contract for recycled scrap, which is the seller’s name and duties: (e) the seller’s name and address in Gyeonggi-do; and (e) the seller’s name and address in Gyeonggi-do, the seller’s name and the seller’s address in Gyeonggi-do-do.
