Reasons
Punishment of the crime
[Criminal Power] On September 26, 2017, the Defendant was sentenced to imprisonment with prison labor for the crime of indecent act by force at the Ulsan District Court on September 26, 201, and the Defendant completed the execution of the sentence at the port prison on January 8, 2019.
【Criminal Facts】
1. On February 6, 2019, at around 18:17, the Defendant was provided with alcohol and food equivalent to KRW 32,00,00,00, in total eight times in total, as indicated in the attached Table of Crimes, from that time until April 6, 2019, as follows: (a) the Defendant: (b) was provided with alcohol and food by a victim C, which was operated by Ulsan-gu, Ulsan-gu; (c) was unable to pay the price even if he was provided with alcohol and food by the victim; and (d) was ordered to provide the victim with drinking and food as if he did not have any intent or ability to pay the price; and (d) was ordered to provide the victim with drinking and food; and (e) was supplied with drinking and food equivalent to KRW 178,00,00,000, in total, from that time, until April 6, 2019.
2. Interference with business;
A. On February 14, 2019, around 20:30 on February 14, 2019, the Defendant requested the victim to provide alcohol and food to the victim at the “D” restaurant operated by the victim C (Nam, 42 years of age) in Ulsan-gu, Ulsan-gu, Seoul-do, but the victim’s refusal to provide alcohol and food to the victim. However, the Defendant repeatedly moved to the outside and outside of the restaurant on the ground that the victim refused to do so, “the alcohol is changed”, “the head of the cafeteria,” and booms the customer at the entrance of the restaurant.
Accordingly, the defendant, by force, interfered with the operation of the victim's restaurant for about 30 minutes.
B. On April 8, 2019, around 19:00 on April 8, 2019, the Defendant committed the crime: (a) stated that the victim F of the Victim F in Ulsan-gu, Ulsan-gu, “G” francing the victim “G,” operated by the victim F of the Victim F in Ulsan-gu E, “I will put in rara, put in flad, put in flad, or put in flad,” and (b) sought to talk with the Defendant at his first hand, and tried to knife the knife in the kitchen.
