Reasons
Punishment of the crime
1. Defendant A, Defendant B, and Nonindicted Party B (one name J and K) were entitled to obtain “the letter of guarantee of loan for living expenses of the large student and office year loan” by submitting a certificate of employment, payment statement, etc. to the Credit Counseling and Recovery Commission, and upon submitting it to the financial institution, Defendant A, Defendant B and Nonindicted Party (one name J andK) were in charge of making a false representation of the loan by providing a forged employment certificate and payment statement to those who need to obtain the loan, and 40% of the loan amount as commission. Defendant B posted an advertisement on the Internet portal site “NAV” bulletin board, etc., and made it possible for those who reported this fact to connect Defendant A and Nonindicted Party B, and Defendant A and Nonindicted Party B were in charge of making the loan by forging documents, such as a certificate of employment, and providing the loan to those who want to obtain the loan.
On March 14, 2016, the Defendants: (a) obtained a loan from L; (b) obtained a certificate of employment and a payment statement form in a computer; (c) used it in the title column of the certificate of employment; (d) “re-issuance certificate” in the column of employment; (d) “Re-issuance on August 23, 2015”; (e) “Earbrate” in the column of employment form; and (e) printed out “N” in the address column of Gyeonggi-do, and marked “N” at the bottom; and (e) stamped the seal of “N” in the column of the payment specification; and (e) marked “O”, “O”, “1,40,000,” and “N” in the bottom of the payment specification; and (e) marked the “N” in the column of “N” and affixed the seal affixed to “N”.
As a result, the Defendants forged the certificate of employment in the name of ‘N' and the statement of wages for the purpose of exercising these certificates in collusion with L.
