Defendant
A shall be punished by a fine of 5,00,000 won, by a fine of 3,00,000 won, and by a fine of 5,00,000 won, respectively.
Reasons
Punishment of the crime
The Defendants, along with F that they came to know through the loan advertisement posted on the bulletin board, such as Internet NAVner, were able to obtain a “year-long loan” by using a credit guarantee from the Credit Counseling and Recovery Commission by forging necessary documents, such as a certificate of employment.
1. Defendant A
A. On May 2016, the Defendant: (a) contacted F with F, which became aware of as above, and requested the Defendant to create documents necessary to obtain “year-age loan for the school year”; and (b) to request it.
As a result, around May 2, 2016, F was released from the PC room which is not located in his/her address by a computer in the form of document describing the sources of service and salary, and used it in the title column of his/her name; “A” in his/her name column; “A” in his/her resident registration number column; “H” in his/her resident registration number column; “H” in his/her current address column; “I of Daegu Metropolitan City Dong-gu, Daegu-gu; “I of May 15 through 02, 2016”; “business division” in his/her service division column; “members” in his/her class column; “Submission of official document; “F: Representative director”; and “B” in the lower part of his/her name column; and then stamped the seal form at the bottom of his/her name; and affixed the seal form at the bottom of “B” in advance and sealed the seal form at the bottom; “I” in his/her service division; and “I of May 20, 2016” column.
Accordingly, the defendant, in collusion with F, forged a certificate of employment and a statement of salary under J, which is a private document related to confirmation of facts.
B. On May 4, 2016, the Defendant in the instant investigation document filed an application for a guarantee of “year-age-long loan” with an employee who is unaware of the forgery at the Daegu-gu Branch of Credit Counseling and Recovery Commission, Daegu-gu, Daegu-gu, for the “year-long Loan” with the employee who was aware of the forgery, and completed the forged employment certificate and the detailed statement as described in paragraph (a).
