A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On November 1, 2019, the Defendant stated that “If you send KRW 500,00 to the account, you will send the Nompt North Korea to the post office’s home page” to the victim G who had contacted the Defendant by reporting the Defendant’s writing posted to sell Mac North 2016 Nompt to the Internet F.

On April 27, 2020, the Defendant posted a letter to the Kimpo-si, Kimpo-si on April 27, 2020, stating that “The Defendant would send the said article to the Victim K, who had contacted with the Defendant by reporting that the Defendant sold the JKa-do location.”

However, since the defendant did not have the above goods, there was no intention or ability to send the goods even if he received money from the victim.

Around April 28, 2020, the Defendant, by deceiving the victim as above, received KRW 400,000 from the victim to the M bank account (N) in the name of the Defendant’s seat on or around April 28, 202.

On February 29, 2020, the Defendant reported that the victim O purchased the Switzerland location in the Internet site around February 29, 2020, and made a false statement to the victim that “I would sell money on the face of remittance.”

However, since the defendant did not have a location to pay money from the victim, the defendant did not have any intention or ability to send the location to him/her even if he/she received money from the victim.
