A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

피고인은 2015. 6. 17. 23:40경 대구 서구 B 앞길에서, 술에 취해 아무런 이유 없이 행인에게 시비를 걸며 뺨을 때렸고, 이에 폭행 피해신고를 받고 출동한 대구서부경찰서 C지구대 소속 경사 D으로부터 사건경위에 관한 질문을 받자 “경찰관 너거들이 뭘 알겠나. 내가 이 동네 유지인데 너거들이 무슨 상관이냐. 꺼져라 이 새끼들아.”라고 말하며 발로 위 D의 낭심 부위를 1회 걷어차 폭행하여 질서유지 및 범죄수사에 관한 경찰관의 정당한 직무집행을 방해하였다.
