Reasons
Punishment of the crime
1. On May 2013, the Defendant: (a) found one cell phone which was lost by the victim B in a park located in the Cheongcheon-si, Cheongcheon-si; and (b) obtained one cell phone from the market price in which the victim B lost.
The Defendant did not take necessary procedures, such as returning the acquired property to the victim, but did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
2. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Kameras and photographing);
A. A. Around May 4, 2013, the Defendant discovered a female under whose name it is shopping in a e-mail store in e-mail, E-mail, Sucheon-si on May 4, 2013, and taken pictures against his will, as seen above, that the Defendant might cause a sense of shame by mobile phone camera.
B. Around May 12, 2013, the Defendant discovered a woman under whose name the head of the eart shop in the Eartzed Dong-si, the Defendant, around 16:47 on May 12, 2013, taken pictures against his/her will, by discovering a woman under whose name the head of the eart shop in the Eartzed Dong-si, and caused a sense of shame by the mobile phone camera that he/she acquired.
C. On August 30, 2013, around 16:30 on August 30, 2013, the Defendant discovered two female students in secret name, who are shoppingized in a store for home appliances of D 2-story D located in Ansan-si, Andong-si, A around 16:30 on August 30, 2013, and the Defendant was aware of and attempted to commit the crime against his/her will, while taking the booms, which could cause a sense of shame by using the acquired cell phone camera.
